- 1st Degree Offense: Distribution or Manufacture
If the quantity is greater than 5 oz. it is a 1st degree criminal offense punishable by up to 20 years in state prison with parole ineligibility for one-third to one-half of the sentence, and a fine of up to $500,000.00 - 2nd Degree Offense: Distribution or Manufacture
If the quantity is more than 1/2 oz. but less then 5 oz. punishable by 7 to 10 years in state prison and a fine of up to $75,000.00. - 3rd Degree Offense: Possession
If the quantity is a dusting but not more than 1/2 oz. it is a 3rd degree criminal offense punishable by 3 to 5 years in state prison and up to a $35,000.00 fine.
Additional Penalties Apply to all NJ Drug Charges, including heroin, cocaine, crack and methamphetamines including mandatory loss of drivers license from 6 months to two years, probation and drug screenings.
