4 Reasons You Need A Will Now and Shouldn't Wait!
- Protect Your Loved Ones: Make sure your money goes to your spouse and/or those you love! Only with a Will can you direct who will distribute and get your assets. Under NJ Law A Spouse Does not get all of your money, not even half if you die without a will.
- Save Money: A little planning today can save you tens of thousands of dollars tomorrow in probate, court costs and lawyer fees, if you don't have a Will drafted now before you die! Most people don't plan the date they die so you need to do this today before its too late!
- You Determine Who Will Take Care of Your Children Rather Than The State of NJ: If both you and your spouse die at the same time like in a car accident NJ Child Protective Services will take your children and place them in foster care, don't you want them to be taken care of by someone you know and trust and have picked to take care of them!
- You Can't Do It Later: Even if you just get disabled it may be too late to get a Will as you need to be of sound mind and body to have a will drafted for you. Once you are no longer of sound mind and body you can't have a will made for you so you must act now!
What happens if you die without a Will:
If you die without a Will the State of New Jersey will determine who gets your car, house, bank accounts and any other assets. Money that you worked so hard to save will be given to people you may not even like. Even your spouse by operation of law may only be entitled to approximately 25% of your estate by operation of law (see below). If you have children and die without a Will, the State will determine who will be the guardian of your children. Someone you don't even know or like may raise your children!
Don't let this happen to you protect yourself, your spouse, your children and your assets before its too late with a simple will from Attorney H. Scott Aalsberg. Living Trust vs. Will: Why a Will May Be Your Smarter Choice:
A properly drafted living trust generally costs several times what a Will generally costs upfront and over your lifetime. Thus, the reason you will see most people choose a simple Will in NJ over a Will and Living Trust. Not only could a Will save you thousands of dollars, in many instances it can accomplish the same task, transferring your money estate tax free to your loved ones.
Simple Will vs. Revocable Living Trust
Cost $1000+ | Cost $3000+ |
---|---|
Taxes Can Be Deferred Until Time of Death or Reduced with Step up Basis at Death for Real Estate | Taxes Can Be Deferred Until Time of Death or Reduced with Step up Basis at Death for Real Estate |
You Can Appointment a Guardian for your children | No Guardianship, State of NJ will decide who takes responsibility of your children |
You can appoint an Executor | No Executor |
Your Estate Must Go Through Probate Fees to Court Generally under $200.00 | You Can Avoid Probate for assets in the trust but not all assets are necessarily in the trust so you still may have to go through probate |
Must Wait 11 Days Until Executor Can File Will | Trustee can dispose of assets immediately |
No Additional Costs You Control Your Money as you do now. | Added Complexity and costs when selling assets and even opening bank accounts due to required documents |
1) You can easily pay $3,000.00 up to $15,000.00 for a properly drafted living or revocable trust vs. a Will could cost less than $1,000.00
2) Most people will leave their money to an exempt person under the NJ inheritance tax law such as:
- Surviving spouses
- Surviving domestic or civil partners
- Children and subsequent direct descendants (grandchildren, great-grandchildren, etc.)
- Parents and other direct ancestors (grandparents, great-grandparents, etc.)
- Step-children (but not subsequent step-descendants)
3) Although a Will may have to go through probate. Probate in NJ unlike other states is a really simple and streamlined process.
Changing all your assets into the trusts name and then changing to the beneficiaries name can cost a lot of time and money much more time and money than even probate. Probate for most people can be done in one visit to the probate office of the court.
Sure you may have to wait for a tax clearance and probate letters (generally takes a few weeks) but it can be easier to do this then to prove and get documents to the bank that you are the proper grantor/grantee of the trusts assets.
4) You still may need a will anyway:
A living trust can’t address everything, such as naming a guardian for minor children, a will is always needed to address any assets that didn’t get transferred into the living trust before death such as a new car or expensive jewelry and thus you may go to probate anyway. Thus, a will is still needed even in many situations where there is a living trust.
5) With a living trust you will need to file a tax return for the trust each year causing upfront expenses.
6) Your Will can include an optional Simple Trust: If you have a beneficiary who is under the age of 18 by law someone who is under the age of 18 cannot inherit money. But a simple trust can solve this problem. A Simple Trust can cost less than $1,000.00 thus saving you thousands less than having a living trust drafted for you.
Don't Spend $3,000.00 or even $15,000.00 on a Complex Living or Revocable Trust. Just Spend for What you Need:
We understand that most people aren't rich. Why pay more for what you may not need. Federal and State Laws are constantly changing thus the reason revocable or living trust documents are recommended to be reviewed by your lawyer yearly for tax changes. In contrast a Will generally only needs to be reviewed every 5 years or upon the death of a grantee.
Contrary, to many people: belief NJ Still doe: have an inheritance tax. However, the following beneficiary: tined below arc exempt. If your leaving money to an exempt person listed below a simple will may be all that you need:
- Surviving spouses
- Surviving domestic or civil partners
- Children and subsequent direct descendants (grandchildren, great-grandchildren, etc.)
- Parents and other direct ancestors (grandparents, great-grandparents, etc.)
- Step-children (but not subsequent step-descendants)
- Qualified charities
- Religious, educational, and medical institutions
- Non-profit benevolent and scientific institutions
- The State of New Jersey
However, Without a properly drafted Will the beneficiary's you want to receive your money may never get it. Thus, the reason to plan your Will today with experienced Will/Estate Planning Lawyer H. Scott Aalsberg!

If Your Married Why You Need A Will For Your Spouse - The Spousal Exemption It Isn't What You Think:
Many people believe that because they are married that they will get all of the assets or even half of the assets of their spouse. False. In NJ a spouse does not get all of the other spouses assets unless they specifically give them those assets In a Will or Trust. In NJ a spouse if no will or other testamentary document exists, in simplified terms will only be entitled to an elective share. This elective share could be as little as 25% for some. See NJSA 313:5-3(c)(1)- C (2 ) which states that the first one-fourth of the intestate estate (but not less than $50,000 or more than $200,000), plus one-half of the balance goes to the spouse by operation of law. Furthermore this amount can be reduced by funeral expenses and other debts owed by the estate. Dont let this happen to you, can you live on just 1/4 of the assets your currently living onl Plan your Will or Estate Plan today and make sure you get protected. The call at 1-800-RIGHTS is free but the consultation and what you will learn may be priceless.
